Choose the court
We size the claim, decide between Small Claims and the Superior Court, and pick the court office the rules allow.
We start claims for Mississauga businesses and individuals from our office at 2960 Drew Road, Unit 139, usually in the Peel courts in Brampton, and serve them on every defendant.

The basic limitation period is two years from the day you knew, or ought to have known, about the loss and who caused it. Some claims have shorter periods, and none can start more than 15 years after the events.
The amount decides the court. Small Claims Court hears money claims of $50,000 or less, not counting interest and costs. Since July 1, 2024, a claim that size can only start in the Superior Court with that court's leave. Above $50,000 the claim goes to the Superior Court, and claims of $200,000 or less follow its simplified procedure.
Once issued, a statement of claim has to be served within six months. A Small Claims plaintiff's claim has the same six months.

Peel's civil claims are heard in Brampton. The Superior Court of Justice sits at 7755 Hurontario Street, and Small Claims courtrooms are next door at 7765. Choosing where to file is a real question for many Mississauga claims, because the businesses on the other side are often in Toronto, Vaughan or out of province. Small Claims rules let a claim start where the events happened or where any defendant lives or does business. In the Superior Court, the claim starts in a county with a rational connection to the dispute. Filing in the wrong place does not end a claim, but a transfer motion costs time, and Peel's civil list is already long.

We name each defendant by its exact legal name and plead the facts, the amount, and the interest claimed.
We file it with the court, then have it served on every defendant inside the six months the rules allow.
If they defend, we plan the next steps. If they don't, we move to note them in default and ask for judgment.
Gather what you have. A missing document is no reason to wait, least of all with a deadline running.
“Great lawyer to work with. Very responsive and accountable. Highly recommended!”
“Telesh Law Firm provides outstanding legal services. The team is highly knowledgeable — I would highly recommend.”
Not always. A Small Claims claim can start where the events happened or where a defendant lives or does business. A Superior Court claim starts in a county with a rational connection to the dispute. When both sides and the events are in Peel, that is Brampton.
Often, if the contract or the loss is connected to Ontario. Serving a defendant outside Ontario has its own rules, and a Superior Court defendant served elsewhere in Canada or the United States gets 40 days to defend instead of 20. We confirm the court has jurisdiction before you pay to issue the claim.
