Choose the court
We size the claim, decide between Small Claims and the Superior Court, and pick the court office the rules allow.
We draft, issue and serve statements of claim and Small Claims plaintiff's claims for Scarborough clients, from our office at 1585 Markham Road, filed with the Toronto court the claim belongs in.

The basic limitation period is two years from the day you knew, or ought to have known, about the loss and who caused it. Some claims have shorter periods, and none can start more than 15 years after the events.
The amount decides the court. Small Claims Court hears money claims of $50,000 or less, not counting interest and costs. Since July 1, 2024, a claim that size can only start in the Superior Court with that court's leave. Above $50,000 the claim goes to the Superior Court, and claims of $200,000 or less follow its simplified procedure.
Once issued, a statement of claim has to be served within six months. A Small Claims plaintiff's claim has the same six months.

A Scarborough claim is a Toronto claim. Under $50,000, not counting interest and costs, it is a plaintiff's claim in the Toronto Small Claims Court at 47 Sheppard Avenue East. Above that, it is a statement of claim in the Superior Court of Justice, whose civil office is at 330 University Avenue. Toronto files Small Claims documents online through the Ontario Courts Public Portal, so you rarely have to stand at the counter. One choice deserves a deliberate decision rather than a default: whether to give up the amount over $50,000 to stay in Small Claims, where the process is shorter and the costs you risk are capped. Once you give up the excess, you cannot sue for it later.
We size the claim, decide between Small Claims and the Superior Court, and pick the court office the rules allow.
We name each defendant by its exact legal name and plead the facts, the amount, and the interest claimed.
We file it with the court, then have it served on every defendant inside the six months the rules allow.
If they defend, we plan the next steps. If they don't, we move to note them in default and ask for judgment.
Gather what you have. A missing document is no reason to wait, least of all with a deadline running.
“Great lawyer to work with. Very responsive and accountable. Highly recommended!”
“Telesh Law Firm provides outstanding legal services. The team is highly knowledgeable — I would highly recommend.”
For $50,000 or less, with the Toronto Small Claims Court at 47 Sheppard Avenue East, which takes online filing. Above that, with the Superior Court of Justice in Toronto. Scarborough has no civil courthouse of its own.
Sometimes. Small Claims is faster and the costs you can be ordered to pay are capped, but the $5,000 is gone for good. We compare the likely cost and time of each court against the amount you would give up before you file.
